Legal aspects of patient safety

Treatment of patients is a high risk activity. There is a question whether we can contribute to the improvement of safety with appropriate legal codification. The aim of this paper is to add a piece to the mosaic from the legal point of view in order to achieve the common goal, more precisely to reduce the number of complications that jeopardise the safety of patients in the health care system. We should seek appropriate legal mechanisms to influence other factors in health care so that we achieve the aforementioned goal. Using law itself does not guarantee success, since law has a curative effect. Frequent and exaggerated legal curative acts due to public demonstration effects cause that positive effects of the development of the »culture of safety« lose efficacy due to the effect of the »culture of fear«. We should identify the ways and possibilities of the preventive action of law and include them in organisational efforts in health care to constantly improve the »culture of safety« in health care systems.
